U.S. to study cancer risks near 6 nuclear plants

The U.S. Nuclear Regulatory Commission announced plans Tuesday to launch a pilot epidemiological study of cancer risks near six nuclear power plants, including San Onofre Nuclear Generating Station in north San Diego County.

The commission is acting out of growing concern that using uranium to produce electricity may be dangerous even without accidents at nuclear plants. In addition, recent epidemiological studies in Germany and France suggest that the children living near nuclear reactors are twice as likely to develop leukemia.

The U.S. study will be conducted by the National Academy of Sciences, which will also help the commission determine whether to extend the study to all 65 U.S. nuclear power plants and certain nuclear fuel sites.

The pilot study will investigate cancer rates in each census tract within a 30-mile radius of the nuclear facilities, and assess cancers in children younger than 15 whose mothers lived near a nuclear facility during pregnancy. About 1 million people live within five miles of operating nuclear plants in the United States, and more than 45 million live within 30 miles, nuclear regulatory officials said.

The study will cost about $2 million and is to begin later this year, with the results available in 2014, commission spokesman Scott Burnell said. Before beginning, researchers will meet with communities near the plants to explain how the study will be conducted, Burnell said.

The academy chose sites that provide a broad representation of engineering designs and operating histories in states that have a variety of data retrieval systems in cancer registries.

The study area around the San Onofre Nuclear Generating Station, which has been out of commission since January because of equipment problems, encompasses 2.4 million people in more than 50 cities, including Laguna Beach, Huntington Beach, Costa Mesa, Santa Ana, Tustin, Lake Elsinore, Temecula, Oceanside, Escondido, Solana Beach and Camp Pendleton.

The last time officials assessed cancer rates near nuclear power plants was in 1990. The National Cancer Institute studied cancer risks posed by the 104 licensed reactors the commission governed at that time. The study concluded that the health risks, if any, were too small to be measured.

The commission has been relying on the results of that study ever since to inform the public about cancer mortality rates near nuclear reactors.

"I'm very pleased about this pilot study," said Roger Johnson, a retired neuroscience professor and member of the nonprofit environmental group San Clemente Green, which has raised safety and health concerns about San Onofre.

"Most people are focused on accidents at nuclear power plants," Johnson said. "They don't realize that they store tons of radioactive material and emit low levels of radioactive waste into the atmosphere."

California shark attack: Why so many great white encounters this year?

A California surfer was killed Tuesday, almost certainly by a great white shark. The attack comes in a year when sightings of white sharks are up on both coasts. Scientists are trying to find out why.

A fatal shark attack off the coast of California Tuesday is raising fresh questions about an uptick in encounters between white sharks and humans along the West Coast and beyond.

Officials are investigating the bite marks in the torso of a man killed at a popular swimming spot near Vandenberg Air Force Base to determine the species of shark in the attack, but experts have suggested that it is almost certainly a great white.

The death is the 13th in California waters since 1950, but the fifth since 2003. That increased rate of fatal attacks, combined with an increasing number of great white sightings this summer on both coasts, has led to speculation over what is behind the increased interface.

The answer is, for now, unclear. Some scientists say better management of the commercial fishing industry has led to a substantial increase in the white shark population. Others suggest that the increasing number of people surfing, swimming, and kayaking has created new opportunities for white sharks and humans to cross paths.

But many experts agree that smartphones are giving people unprecedented ability to record white shark encounters ? adding to the attention these encounters receive ? and they say the pattern of attacks and sightings fits well into their understanding of the shark's seasonal migrations.

Above all, they agree that data show white shark attacks remain exceedingly rare, and the threat posed by them is small.

The issue first gained attention in July, when a white shark bit a kayak off Santa Cruz, Calif., throwing the man out of his boat. He was unhurt. The same week, a white shark was photographed trailing a kayak off Cape Cod, though it never attacked.

The Cape saw a record number of white shark sightings this summer. Likewise, officials in Santa Barbara, Calif., have been surprised at the number of white-shark sightings.

?It?s very unusual to see this many white sharks in our area,? Mick Kronman, harbor operations manager with the city?s Waterfront Department, told Noozhawk, a local news website. ?They?ve been really close.?

Santa Barbara officials responded by posting warning signs at beaches for the first time. Cape Cod officials are currently discussing how to handle the situation.

On the Cape, a growth of the seal population is seen as bringing more white sharks, which feed on the seals. Similar dynamics could be in play off the California coast. The sightings here could signal that marine ecosystems are becoming more healthy after the passage laws targeting overfishing, such as the Marine Mammal Protection Act of 1972 and a ban on near-shore gill nets in 1994.

According to one estimate, there could be a few as 300 white sharks in California waters. But whether that represents an increase, decrease, or steady number is virtually impossible to know.

?We can?t know what low means because we don?t know how many there were prior to human fishing pressure,? says Chris Lowe, a marine biologist at California State University, Long Beach.

He suggests that the number of white sharks off California has increased significantly in recent years. ?They?ve made a comeback bigger than most biologists would imagine,? he says.

But Andrew Nosal of the Scripps Institution of Oceanography in La Jolla, Calif., told the Los Angeles Times that he attributes the increased interface between humans and white sharks more to human activity.

What is more certain is the seasonal regularity.

Pacific white sharks hang out in what is known as the ?White Shark Caf?? about 1,000 miles off shore for about six months of the year and then head for the Baja Peninsula. The migration takes about three weeks of swimming high speed for 50 miles per day, leaving them famished when they arrive near land. As they move northward throughout the summer and autumn into California waters, they're scouring the coastline where their prey lives ? and where humans frolic.

?There is most definitely a seasonal pattern to this,? says Sal Jorgenson, senior researcher at the Monterey Bay Aquarium.

Despite all this, white sharks pose no serious threat to humans, says Dr. Lowe. ?More people are killed driving to the beach, and yet we all take that risk.?

Current Biology

NOC, seen here in an image from an archival video, was recorded in the 1980s making vocalizations that imitated human speech. The findings weren't published until this week.

Whales are among the great communicators of the animal world. They produce all sorts of sounds: squeaks, whistles and even epic arias worthy of an opera house.

And one whale in particular has apparently done something that's never been documented before: He imitated human speech.

'); } }, onPlay: function() { if ($("#jwPlayer163471197_wrapper .loading").length > 0){ $('#jwPlayer163471197_wrapper .loading').remove(); } } } }); } } catch (e) { NPR.messaging.exception(e, 'jw player javascript', 'look in CommonJwPlayer.inc', NPR.messaging.constants.PLAYER_JS_ERROR); };

Sounds From The Whale Named NOC

'); } }, onPlay: function() { if ($("#jwPlayer163471196_wrapper .loading").length > 0){ $('#jwPlayer163471196_wrapper .loading').remove(); } } } }); } } catch (e) { NPR.messaging.exception(e, 'jw player javascript', 'look in CommonJwPlayer.inc', NPR.messaging.constants.PLAYER_JS_ERROR); };

Normal White Whale Sounds

The beluga, or white whale, is smallish as whales go and very cute, if you're into marine mammals. Belugas are called the "canaries of the sea" because they're very vocal.

These sounds are for things like echolocation, like bats use, or for basic communication, as in, "Hello, honey, I'm home."

But a white whale at San Diego's National Marine Mammal Foundation did something very different. NOC (pronounced Nocee), as he was called, lived in an enclosure in the San Diego Bay. Biologist Sam Ridgway was there one day when divers were swimming nearby. "This one diver surfaced next to the whale pen and said, 'Who told me to get out?' And the supervisor said, 'Nobody said anything.' "

A curious Ridgway started recording NOC. And what he heard was quite strange: It had the cadence and rhythm of human speech. No words were distinguishable, but the sounds were eerily "right." Ridgway laid out audiograms of NOC's chatter, and they showed that the rhythm and pitch were different from NOC's normal sounds: They were, in fact, very similar to human speech. NOC had lowered the pitch of his sounds several octaves below normal, into the range of human speech at 300-400 hertz.

This archival video shows the white whale named NOC swimming around researchers' boats. (Note: This video has no sound.)

Ridgway says there's no reason to think NOC understood speech; he was just mimicking humans he'd heard. From where? "I think it was from divers using underwater communication equipment," he says.

When NOC was mimicking humans, Ridgway looked inside the whale's nose. "He did an unusual thing that we had never seen before in any of these animals," Ridgway recalls, "which was, he overinflated the two large sacs that kind of collect air to make sound."

This all took place in the mid-1980s. After a few years, NOC stopped talking. He lived to be 30 and died five years ago. Ridgway just published his research in the journal Current Biology. He says he would have done it earlier, but thought a talking whale was a "side issue."

In Consulting, Attitude Is Everything|Women In Consulting Blog

Every year, Women in Consulting (WIC) conducts an annual survey on consulting best practices and compensation. I?ve had the pleasure of working with Jennifer Berkley-Jackson on this survey for the past three years (this is the 11th anniversary of the survey?and Jen has done all eleven!), and every year, attitude appears amongst the advice participants offer for building your business.

And attitude really is everything. If you?re good but you have doubts, it impacts your business. If you?re impatient, it impacts your business. If you?re negative, it impacts your business. You get the idea.

Four of my favorite quotes from this year?s survey really some up the importance of attitude in consulting:

?Keep a positive attitude. Things can change dramatically in a week.?

?Stick with it?some days, just showing up counts for a lot. And remember, if it were all that damn easy, everybody would be doing it.?

?If you believe you have a service/product to offer the world, put together a strong plan to achieve specific goals. Don?t let nay-sayers take your vision from you. It takes up to three years to really get a business up and running, where your phone is ringing. Believe in yourself and don?t give up.?

?Be brave enough to raise your rates! If you were a full-time employee, you?d get a regular raise; and yet consultants are so timid to ask for a raise, they go for years without any increase.?

So, remember?

  • Be bold
  • Be positive
  • Be generous
  • Be patient
  • Be yourself
  • Believe in yourself and ask for what you?re worth

And?

?let me know what you do to keep your attitude flying high and how it helps your business.

And?

?if hasn?t worked for you, I want to hear from you, too!

And (the last one, I promise!)?

?if you want to learn more about the results of WIC?s 11th Annual Consulting Best Practices and Compensation Survey, join us for our webinar on November 7 at 11am PDT. If you can?t make it, the webinar will also be available on-demand. The full survey report will also be made available to WIC full and leaders? network members around mid-October. If you?re not a full member and are interested in learning more, we have information on our website.

Berdych downs Tsonga to capture Stockholm title | Tennis | Rock Hill ...

Tomas Berdych outlasted Jo-Wilfried Tsonga in Sunday's final at the Stockholm Open.

The second-seeded Berdych rallied past Tsonga, the No. 1 seed, 4-6, 6-4, 6-4.

Berdych improved to 2-2 in finals this year, beating Gael Monfils to win the Montpellier title in February before losing in the Madrid final to Roger Federer in May and falling to John Isner in the final at Winston-Salem in August.

The Czech is now 8-8 for his career in title matches.

"It feels pretty good to have won a second title this season," Berdych said. "When I was 2-4 down in the second set, I remained positive and focused on my game. Against Jo you have to stay positive until the last point. I am happy that I was able to turnaround the match and that's what makes this title special."

Tsonga was trying to win his third title of 2012. He won in Doha to start the campaign in January and also captured the Metz crown in September.

Berdych is 3-1 lifetime against Tsonga.

With the victory, Berdych took home $113,795.

Understanding The Fundamentals Of Elder Law ? hot news

People have over the years become more health conscious. A very high percentage of individuals especially in developed countries work out regularly. Together with the modern medical facilities this has increased the life span of individuals. Elders of the present age are more active then their ancestors. And hence the legal issues surrounding them too have increased. Increase in the number of elder law cases is an offshoot of the global development in the twentieth century.

Elders are often worried about how to take care of their life time savings and the assets earned, bought or inherited in better days of life. This leads to more legal complications. Estate planning and maintenance is the most popular topic in Elder law. Many elders don?t understand tax treatment of it and often seek help of special attorneys. Health related issues such as getting Medicaid help is the second category of elder law cases. Understanding benefits of any government sponsored elder support program or benefits from health insurance policy are difficult for a common senior citizen and they often seek help of lawyers who specialize in this area. Every individual past the age of 60 would always wish that his or her assets be smoothly passed on to children or others of their choice after he or she is no more. To make this easy, laws have been frame to cover these issues. This is the third popular category of elder laws.

Creating Will is one of the first things that an ageing individual should do. Governments across the world have framed clear laws about creation of Will and disposal of assets covered under the Will. You can also choose who will execute the Will and who will become guardian of your minor children. If you fail to make a Will, the local laws will decide who will inherit your wealth. And this often creates bitter issues between family members, especially if you have married more than once and has more than one child. Apart from Will, one should understand the laws related to power of attorney. If you need the help of someone to take care of your estate while your are living, laws related to power of attorney can help you. You can then give necessary rights to the estate care-taker without worrying about loss of its ownership.

Understanding health support programs such as Medicaid or Veteran support programs in the US is very critical. Always have an elder law lawyer to help you understand your eligibility under these programs. If you have a disability, there are more laws that can potentially help you. Special ailments too receive special benefits under these laws. Governments have also made laws related to elder abuse issue. Rates of domestic crime are increasing every day. Consult your attorney immediately if you have such issues.

Legal issues are bound to arise as you age. And hence it is imperative for anyone to understand elder law and how it can help you solve these issues. A little effort can help you spend the last years of your life in peace and tranquility.

The Business of Sustainable Water Management | The Energy ...

Businesses are increasingly taking stock of water management and risk as a cornerstone of sustainability U.S. corporations are increasingly looking to sustainable water management standards that exceed the statutes of the Clean Water Act?(CWA).? The CWA was passed 40 years ago on October 18th, 1972, it establishes the basic structure for regulating discharges of pollutants into U.S. waters. Although the CWA has not met its original goal of eliminating pollutants, some businesses are nonetheless showing initiative.

According to a 2011 study, global warming will diminish global supplies of fresh water. Although these findings?focus?on urban centers in South America, it is likely that we will see more widespread water loss due to evaporation caused by warmer temperatures. In the U.S., water problems associated with climate change are not a problem of the future. The drought of 2012 reveals that we are already experiencing the effects of a warming planet.

A report from the 2030 Water Resources Group (PDF), including the International Finance Corporation and McKinsey & Company, found that the world faces a 40 percent global shortfall between forecasted water demand and availability by 2030.

Agriculture takes up most of human water use and groundwater levels have already dropped in the western U.S., according to a pair of studies of satellite gravity monitoring data conducted by researchers at the University of California Center for Hydrologic Modeling in Irvine, Science News reports.

Farmers in California?s Central Valley, which accounts for nearly 1/6 of irrigated land in the entire country, pump nearly 4 cubic kilometers of water per year out from underground. In addition to farming, dams and channelization are two pervasive threats to freshwater ecosystems today.

Some of the main causes of marine pollution are nitrogen dioxide, sulfur dioxide, ocean acidification, ozone depleting substances, dredging, rising sea levels, ocean dumping, pollution from cruise ships, marine debris, noise pollution from ships, oil spills and plastic.

NGOs and Government

As reported by Environmental Leader, there are numerous foundations working on water issues. They include the World Resources Institute, CERES, the Gates Foundation, One.org, the Johnson Foundation at Wingspread, Water.org, and the Safe Water Network.

In 2007, the UN Secretary-General launched the Global Compact?s CEO Water Mandate, a public-private initiative designed to assist companies in the development, implementation and disclosure of water sustainability policies and practices. The CEO Water Mandate seeks to build an international movement of committed companies, both leaders and learners. In this spirit, it is open to companies of all sizes and sectors.

The U.S. government is also involved in water issues through agencies like the U.S. Department of State, USAID, the US Department of Commerce, the US Department of Agriculture and the US Environmental Protection Agency. In February 2012, the US Department of State convened a roundtable to discuss forming the US Water Partnership. The partnership coordinates divergent water efforts among industry, NGOs and US government agencies.

The 2030 Water Resources Group (WRG) is working to foster collaboration between the public and private sectors that create sustainable solutions to water scarcity.

Business

Jonas Kron is an investment adviser at Trillium Asset Management, he worries about the business of water. Trillium focuses on environmentally sustainable investments, and he is concerned that the $900 million?fund that he manages will be impacted by the world?s dwindling supply of fresh water. However, Kron believes that most companies will eventually realize they need to factor?climate change and water risk into their bottom line.

It is becoming increasingly obvious to many businesses that there is not an infinite supply of clean, usable water. Many corporations are cutting back on water consumption. A number of large multinationals are actively engaged in water management issues.

In 2010, the U.S. Securities and Exchange Commission required publicly traded companies to disclose water related issues. According to the 2011 CDP Water Disclosure Global Report 2011, more companies view water as a business opportunity (63 percent) than a risk (59 percent). The opportunities range from the savings realized by using less to potential new products and services. Nearly 80 percent see those opportunities impacting business in the next five years.

A 2010 Ceres survey found that 39 percent of 150 respondents had already experienced negative water-related impacts. They included disruption to operations from drought or flooding, declining water quality that required costly on-site pretreatment, increases in water prices, and fines and litigation relating to pollution incidents.

A June 2012 report from Ceres said Anheuser-Busch InBev, Coca-Cola and Pepsi are among the 27 percent of companies that see the connection between climate change and water risk.? As reviewed in a 2012 Environmental Leader report, big beverage companies including Coca-Cola, PepsiCo, Miller and MolsonCoors have identified long-term water supply as a risk.

In 2006, the Beverage Industry Environmental Roundtable was created to address water and energy issues. USA Today has indicated total amount of money invested in water conservation projects by beverage companies over the past five years at more than $500 million.

In 2010, Coca-Cola estimated that its facilities have reused more than 2,294,000 kiloliters of rainwater or treated wastewater. About 39 percent of Coca-Cola facilities have indicated that they reuse water before or after treatment. Coca-Cola has developed a beverage process water recovery system that can reduce a manufacturing plant?s water use by up to 35 percent. The company has pledged to improve water efficiency a total of 20 percent by the end of 2012, compared with a 2004 baseline.

In 2011, Pepsi met its goal of improving water use efficiency 20 percent by 2015, compared with a 2006 baseline. Pepsi also says it will provide 3 million people with access to clean drinking water by 2015.

The Dr Pepper Snapple Group has pledged $1 million over the next four years to protect Texas watersheds that provide water for its bottling plants. By 2015, Dr Pepper plans to cut water use and wastewater discharge 10 percent per gallon of finished product, compared to 2009 levels.

IBM treats and converts millions of gallons of water in their Burlington, Vermont, semiconductor plant and between 2000 and 2009, it cut water usage by 29 percent, saving $3.6 million per year. Ford Motor Co. cut water use by 62 percent between 2000 and 2010; now the company hopes to cut use by another 30 percent over the next three years. Sun World, a Bakersfield, Calif.-based fruit grower, redesigned its irrigation system and lowered water consumption by nearly 9 percent.

Nike has committed itself to a 15 percent improvement in water use by 2015 as compared to a 2011 baseline. A Google data center in Georgia is conserving up to 30 percent of the water it uses with the help of a reuse system.

Another Environmental Leader article reports that water was an important issue at the Rio+20 Earth Summit. CEOs from Coca-Cola Company, Pepsico, Levi Strauss & Co., Royal Dutch Shell, Unilever and 40 other international companies agreed to set targets on their own water efficiency and wastewater management in factories and operations, and called on governments attending to make global water security a top priority.

In an initiative known as the Global Compact?s CEO Water Mandate, companies have pledged to work with suppliers to improve their water practices, and partner with nongovernmental organizations, UN agencies, governments and public authorities, investors, and other stakeholders on water-related projects and solutions.

Solutions

According to a United Nations Environment Programme (UNEP) report, cleaning and managing our seas could reduce pollution and boost economic growth.

Early in 2012, the Hill reported on the Obama administration?s ocean-protection strategy that outlines steps for federal agencies to meet the goals of a 2010 executive order. The plan includes improved spill response capabilities in the Arctic; an assessment of the impacts of climate change (including sea-level rise); improved management of ocean ecosystems; increased reliance on science and data; and increased collaboration with stakeholders and agencies.

Another valuable approach to reducing ocean pollution comes from preventing fertilizers like nitrogen and phosphorous from reaching waterways. Cleaner fuels and more energy-efficient ship designs could also help cut emissions from the maritime industry. Better irrigation systems would help to reduce water usage and channel water runoff into aquifers.

Businesses are increasingly employing the standardized methodologies used in a corporate water strategy:

  • Step 1: Know your water sources, use, consumption and discharge for all operations. Benchmark operations, set targets and drive efficiency.
  • Step 2: Establish a cross-functional water team to define a viable three-to-five-year water stewardship vision that is measurable and aligned with overall business goals.
  • Step 3: Complete a baseline water risk assessment to understand and compare local watershed conditions beyond the four walls of each facility.? Examine risks and opportunities including physical, regulatory and reputational.
  • Step 4: Develop, implement and maintain local water management plans (e.g., location or site specific) based upon Step 3 results. Incorporate performance monitoring systems and issue escalation processes.
  • Step 5: Engage with supply chain partners to understand your company?s broader water footprint, impact and opportunities.
  • Step 6: Strategically engage with external stakeholders through partnerships, reporting and other related efforts.

Businesses are benefiting from the greater availability of data, tools, and best practices. Corporations are increasingly taking stock of the risks and opportunities posed by water, and they?re also becoming more adept at collecting and reporting water data.

Water issues are slowly working their way up the corporate sustainability agenda and emerging as a core business issue. Companies without sustainable water management practices risk having restricted access to capital, high loan rates, and inflated insurance premiums.

Restaurant cell phone distractions still irritate

ALBANY, N.Y. (AP) ? The digital divide is wider than ever between diners who talk, tweet and snap pictures mid-meal and those who wish they'd just shut up, shut down and be present.

Caught at the center of the discord are restaurant owners and chefs, who must walk the careful line of good customer service for both those who dine under the influence of smart phones, and those who won't. But as the devices have morphed into an unrelenting appendage for texting, photography and games, more restaurateurs are challenged to keep the peace.

Owners who once relied mostly on "no cell phones, please" signs, increasingly are experimenting with everything from penalties for using phones, discounts for not and outright bans on photography.

"There's no place to get away from the chatter," said Julie Liberty of Miami, who started the Facebook page "Ban Cell Phones From Restaurants" earlier this year. "Everything has a soundtrack, including when you go into the ladies room. That's just not right."

It's a touchy issue. Consider the crush of news coverage Eva Restaurant in Los Angeles generated when it began offering patrons a 5 percent discount if they leave their phone at the door. Online comments ranged from cheers of "YES!" to others who said their phones would have to be pried from their cold, dead hands.

The policy is working, though. Eva's Rom Toulon said about 40 percent of our customers will leave their cell phones at the door.

"After a few cocktails and glasses of wine, it can be challenging to remember that you left the phone behind," he said.

The burst of headlines for Eva came after a Burlington, Vt., deli took on cyber-folk hero status for posting a sign informing customers that $3 will be added to their bill "if you fail to get off your phone while at the counter. It's rude." Disgusted diners are doing their part too with games like "phone stack," in which everyone places their phones in a stack in the middle of the table. The first person who reaches for their phone pays the bill for all.

These are more creative approaches to the no cell-phone signs now common in restaurants ranging from highbrow to quick-eats. The landmark Boston restaurant Locke-Ober asks diners ? in language appropriate for a place with a dress code ? to "kindly refrain from using cellular phones." In Albany, N.Y., the Hamilton Street Cafe has a more direct, hand-drawn "No cell phones at the counter" sign with a phone with a red "X'' through it.

Owner Sue Dayton said the sign by the counter helps keep the lunch line moving.

"You get a half-hour for lunch. You walk up here and you have to stand behind someone not paying attention enough to say what kind of bread they want on their BLT because they're on their cell phone," Dayton said.

Irritation over distracted dining has broadened with the rise of photo-sharing apps like Instagram. The popular online scrapbook Pinterest is clogged with pictures of everything from pan fried noodles to poutine snapped moments before digestion. Chefs ? who, as a rule, put a premium on control ? don't always take kindly to their dining rooms becoming shooting galleries.

Grant Achatz, the famous Chicago-based molecular gastronomist, wrote a much-forwarded post several years ago grousing about diners who snap the meal away and even try to video his staff without asking permission. "I can't imagine how celebrities feel," he wrote. "No wonder they punch the paparazzi out when they get the chance."

Some restaurateurs go with the digital flow. Sarabeth Levine, of New York City-based Sarabeth's, said she's perfectly fine with people chatting, playing games or even taking pictures. It's free advertising, after all.

"I'm happy to have our customers," Levine said. "They come, they tweet, they Facebook, they bring their children. It's high energy to begin with. I mean, people are noisy even in the way they speak today."

Other restaurants go as far as to bar picture taking, like David Chang's Ko in Manhattan. Others take a middle ground, like the high-end Washington, D.C., restaurant Rogue 24, where hostesses politely tell guests that if they do take pictures, please do so without a distracting flash.

"I mean you can't fight it," said owner R. J. Cooper. "Why fight a losing battle?"

Actually, the battle might already be lost.

The use of hand-held devices at the table is implicitly encouraged at the growing number of restaurants that offer Wi-Fi access or accept payment via smartphone. The Manhattan restaurant Comodo even encourages guests to upload pictures of their dishes to Instagram with the hashtag (hash)comodomenu to create a user-generated "Instagram menu." Sharing trends are likely to accelerate as the generation who has no memory of a world before cell phones comes of age.

Already, about one in five U.S. adults say they share online when eating a meal with others, and more than a third of teens do the same, according to the 2012 State of Mobile Etiquette Survey for Intel Corp.

The same survey found 81 percent of U.S. adults believe mobile manners are getting worse, up 6 percentage points from last year. A Zagat survey this month found most respondents disapproving of texting, tweeting and emailing when eating out, but a majority accepted picture taking.

"I think it's about having more time under our belt with what the new normal is," said etiquette expert Anna Post, the great-great-granddaughter of Emily Post.

While the technology is new, the rules of etiquette are old-fashioned common sense. Silence your phone in restaurants and don't answer unless there's a very good reason, like a sick kid back home. And if you do answer, excuse yourself from the table. Try to keep your phone off the table, it signals to your companions that you waiting for something better.

James Bond, bisexual? 007 has erotic scene

By Gael Fashingbauer Cooper, NBC News

Warning: Possible spoilers for the upcoming James Bond movie "Skyfall" ahead. For 50 years, James Bond has been the consummate ladies' man. But could the fictional secret agent also have a little romantic experience with men?

    Columbia Pictures

Daniel Craig and Javier Bardem in "Skyfall."

According to Movieline, there's a scene in the upcoming Bond film, "Skyfall," where Bond (Daniel Craig) and film villain Silva (Javier Bardem) do a little flirting. Bond is tied up, and the villain gives Craig's sexy secret agent chest a caress.

Reports Movieline, "In response to Silva's attentions, 007 replies, 'What makes you think this is my first time?'"

Writer Frank DiGiacomo reports that reporters asked about the scene at a press conference, and Craig praised the encounter, calling the back-and-forth "a game of cards," and notes that "I don't see the world in sexual divisions."

DiGiacomo's takeaway? "Bond isn't bi," he writes.?

A commenter on the Huffington Post story about the scene?wrote, "I've never seen Bond as having those undertones, but I could easily see him opportunistically playing to the prejudices of anyone. If he were bi, it wouldn't bother me. It wouldn't surprise me either. Bond honestly strikes me as the kind of guy into things that would make simply being bi seem quaint."

And another Huffington Post reader had another take, writing "C'mon, every guy is a little gay for James Bond."

"Skyfall" opens in the U.S. on Nov. 9.

Nine Westmeath couples enter civil partnerships - News - Roundup ...

    | Print | Email |

    Updated: Thursday, 18th October, 2012 2:58pm

Nine same sex couples from Westmeath have entered into civil partnerships since they were introduced in April of last year.

According to recently released statistics from the Gay and Lesbian Equality Network (GLEN), while nine Westmeath couples have obtained civil partnerships, 11 civil partnership ceremonies have taken place in the county between April 2011 and the end of September 2012.

Nationally, 862 civil partnerships have taken place, with 528 gay couples taking the plunge and 334 lesbian couples. While civil partnership ceremonies have taken place in every county in Ireland, more than half of the couples (457) live in Dublin, and 60 couples live in Dublin 8.

Of the 1,724 people that entered into civil partnerships in the last year and a half, more than 1000 are aged between 30 and 50; 14 were over 70 and 11 were between the ages of 18 and 20.

According to Kieran Rose from GLEN, the figures show that civil partnerships have been a "resounding success", but added that civil marriage is the "next step" for same sex couples.

"These couples are the pioneers who are transforming the perception of lesbian and gay relationships all across the country," he said.

Civil partners have the same rights and obligations as opposite-sex married couples in an extensive range of areas including tax, inheritance, next of kin, social welfare, immigration, pensions, home protection and have the same protections as married couples in employment and equality protections.

Ada Lovelace Day book review: Maria Mitchell and the Sexing of Science.

Today is Ada Lovelace Day. Last year, I shared my reflections on Ada herself. This year, I?d like to celebrate the day by pointing you to a book about another pioneering woman of science, Maria Mitchell.

Maria Mitchell and the Sexing of Science: An Astronomer among the American Romantics
    by Ren?e Bergland
    Boston: Beacon Press
    2008

What is it like to be a woman scientist? In a society where being a woman is somehow a distinct experience from being an ordinary human being, the answer to this question can be complicated. And, in a time and place where being a scientist, being a professional ? indeed, even being American ? was still something that was very much under construction, the complexities of the answer can add up to a biography of that time, that place, that swirl of intellectual and cultural ferment, as well as of that woman scientist.

The astronomer Maria Mitchell was not only a pioneering woman scientist in the early history of the United States, but she was one of the nation?s first professional scientists. Ren?e Bergland?s biography of Mitchell illuminates a confluence of circumstances that made it possible for Mitchell to make her scientific contributions ? to be a scientist at all. At the same time, it tracks a retrograde cultural swing of which Mitchell herself was aware: a loss, during Mitchell?s lifetime, of educational and career opportunities for women in the sciences.

Maria Mitchell was the daughter of two people who were passionate about learning, and about each other. Her mother, Lydia Coleman Mitchell, worked at both of Nantucket?s lending libraries in order to avail herself of their collections. Her father, William Mitchell, turned down a spot as a student at Harvard ? which Lydia, as a woman, was barred from attending ? to stay on Nantucket and make a life with Lydia. Maria was born in 1818, the third child of ten (nine of whom survived to adulthood) in a family that nurtured its daughters as well as its sons and where a near constant scarcity of resources prompted both hard work and ingenuity.

William Mitchell was one of the Nantucket men who didn?t go to sea on a whaling ship, working instead on the island in a variety of capacities, including astronomer. His astronomical knowledge was welcomed by the community in public lectures (since youth who planned to go to sea would benefit from an understanding of astronomy if they wanted to be able to navigate by the stars), and he used his expertise to calibrate the chronometers ship captains used to track their longitude while at sea.

Since he was not off at sea, William was there with Lydia overseeing the education of the Mitchell children, much of it taking place in the Mitchell home. Nantucket did not establish a public school until 1827; when it did, its first principal was William Mitchell. Maria attended the public school for the few years her father was principal, then followed him to the private school he founded on the island. William?s astronomical work, conducted at home, was part of Maria?s education, and by the time she was 11 years old, she was acting as his assistant in the work. As it was not long before Maria?s mathematical abilities and training (most of it self-taught) soon exceeded her father?s, this was a beneficial relationship on both sides.

Maria herself did some teaching of the island?s children. Later she ran the Nantucket Atheneum, a cross between a community library and a center of culture. All the while, she continued to assist her father with astronomical observations and provided the computational power that drove their collaboration. She made nightly use of the rooftop observatory at the Pacific Bank (where the Mitchell family lived when William took a post there), and one evening in 1847, Maria?s sweeps of the heavens with her telescope revealed a streak in the sky that she recognized as a new comet.

The announcement of the comet beyond the Mitchell family gives us a glimpse into just what was at stake in such a discovery. Maria herself was inclined towards modesty, some might argue pathologically so. William, however, insisted that the news must be shared, and contacted the astronomers at Harvard he knew owing to his own work. As Bergland describes it:

When Mitchell discovered the comet and her father reported it to the Bonds at Harvard [William Bonds was the director of the Harvard Observatory, his son George his assistant], the college president at the time, Edward Everett, saw an opening: Mitchell was a remarkably appealing woman whose talent and modesty were equally indisputable. She could never be accused of being a status seeker. But if Everett could convince the Danish government [which was offering a medal to the discoverer of a new comet] that reporting her discovery to the Harvard Observatory was the equivalent of reporting the discovery to the British Royal Observatory or the Danish Royal Observatory, the Harvard Observatory would gain the status of an international astronomical authority.

Maria was something of a pawn here. She was proud of her discovery, but her intense shyness made her reluctant to publicize it. Yet that shyness was exactly what made her so useful to President Everett. Her friend George Bond had also discovered comets, but he?d been unsuccessful at arguing on his own behalf against the authorities of Europe. Since Bond was directly affiliated with the Harvard College Observatory, Harvard?s hands were tied; Everett had never even tried to defend Bond?s claims. But by framing Mitchell as something of a damsel in distress, Everett could bring his diplomatic skills to bear to establish the precedent that Harvard?s observatory was as reliable as the British Royal Observatory at Greenwich. (p. 67)

There was more than just a (potential) scientific priority battle here (as other astronomers had observed this comet within a few days of Maria Mitchell?s observation of it), there was a battle for institutional credibility for Harvard and for international credibility for the United States as a nation that could produce both important science and serious scientists. Thus, ?Miss Mitchell?s Comet? took on a larger significance. While Harvard at the time would have had no use for a woman student, nor for a woman professor, they found it useful to recognize Maria Mitchell as a legitimate astronomer, since doing so advanced their broader interests.

Maria Mitchell?s claim to priority for the comet (one that turned out to have an unusual orbit that was tricky to calculate) was recognized. Besides the Danish medal, this recognition got her a job. In 1849, she was hired by the United States Nautical Almanac as the ?computer of Venus?, making her one of the country?s very first professional astronomers.

Her fame as an astronomer also opened doors for her (including doors to observatories) as she left Nantucket in 1857 to tour Europe. The trip was one she hoped would give her a good sense of where scientific research was headed. As it turned out, it also gave her a sense of herself as an American, a scientist, and a woman moving in a very male milieu. Maria Mitchell was horrified to encounter neglected telescopes and rules that banned women from even setting foot within certain university facilities. She rubbed shoulders with famous scientists, including one Charles Babbage and Mary Somerville, the woman William Whewell invented the word ?scientist? to describe:

When Whewell groped for words and finally coined ?scientist? to describe her, the issue was not primarily gender, but rather the newness of Somerville?s endeavor ? her attempt to connect all the physical sciences to one another. ?

Another, even more important reason that Whewell ? felt the need for a new term was that a new professional identity was developing. Those who studied the material world were beginning to distinguish themselves from philosophers, whose provinces were more metaphysical than physical. But the first steps of this separation had been quite insulated from each other: chemists, mathematicians, astronomers, and the soon-to-be-named physicists did not necessarily see themselves as sharing an identity or as working at a common endeavor. Somerville?s treatise On the Connexion of the Physical Sciences was instrumental in showing the various investigators that their work was connected ? they were all practitioners of science.

Although the development of the word ?scientist? related more to the philosophical point (argued by Somerville) that the sciences could be unified than it did to gender, ?scientist? did gradually replace the older formulation, ?man of science.? Gender also entered in, Whewell thought, because as a woman, Somerville was better equipped to see connection than a man. ? Whewell argued that Somerville?s womanly perspective enhanced rather than obscured her vision. (pp. 146-147)

In Somerville, Mitchell found a woman who was a fellow pioneer on something of a new frontier in terms of how doing science was perceived. Though the time Mitchell spent with Somerville was brief, the relationship involved real mentoring:

Somerville talked to her about substantive scientific questions as none of the British scientists had done; Mitchell first learned about the works of the physicist James Prescott Joule in Florence [where she met Somerville], despite having spent months in scientific circles in England, where Joule lived and worked. Somerville took Mitchell seriously as an intellect, and wanted to share her wide-ranging knowledge and encourage Mitchell in her own endeavors. She made her affection for Mitchell clear, and she offered the support and encouragement the younger scientist needed. Best of all, Mitchell liked her. She was charming and kind, someone for Mitchell to emulate in every way. (p. 151)

Somerville was not just a role model for Mitchell. The reciprocal nature of their relationship made her a true mentor for Mitchell, someone whose faith in Mitchell?s capabilities helped Mitchell herself to understand what she might accomplish. This relationship launched Mitchell towards greater engagement with the public when she returned to the U.S.

Maria Mitchell broke more ground when she was hired by the newly formed Vassar College (a women?s college) as a professor of astronomy. While she was first interviewed for the position in 1862, the trustees were locked in debate over whether a woman could properly be a professor at the college, and Mitchell was not actually appointed until 1865. Her appointment included an observatory where Mitchell conducted research, taught, and lived. At Vassar, she broke with the authoritarian, lecture-style instruction common in other departments. Instead, she engaged her students in hands-on, active learning, challenged them to challenge her, and involved them in astronomical research. And, when it became clear that there was not enough time in a day to fully meet the competing demands of teaching and research (plus other professional duties and her duties to her family), Mitchell recorded a resolution in her notebook:

RESOLVED: In case of my outliving father and being in good health, to give my efforts to the intellectual culture of women, without regard to salary. (p. 203)

Such a commitment was vital to Maria Mitchell, especially as, during her time at Vassar, she was aware of a societal shift that was narrowing opportunities for women to participate in the sciences or in intellectual pursuits, in the realms of both education and professions. Pioneer though she was, she saw her female students being offered less by the world than she was, and it made her sad and angry.

Ren?e Bergland?s biography of Maria Mitchell lays out the complexities at work in Mitchell?s family environment, in the culturally rich yet geographically isolated Nantucket island, in the young United States, and in the broader international community of scientific thinkers and researchers. The factors that play a role in a person?s educational and intellectual trajectory are fascinating to me, in part because so many of them seem like they?re just a matter of chance. How important was it to Maria Mitchell?s success that she grew up in Nantucket, when she did, with the parents that she had? If she had grown up in Ohio or Europe, if she had been born a few decades earlier or later, if her parents had been less enthusiastic about education, is there any way she would have become an astronomer? How much of the early recognition of Mitchell?s work was connected to the struggle of the U.S. as a relatively new country to establish itself in the international community of science? (Does it even make sense to think of an international community of science in the mid-nineteenth century? Was it less about having American scientists accepted into such a community and more about national bragging rights? What might be the current state of the U.S. scientifically if other opportunities to establish national prowess had been pursued instead?)

Especially gripping are the questions about the proper role of females in scientific pursuits, and how what was ?proper? seemed contingent upon external factors, including the availability (or not) of men for scientific labors during the American Civil War. I was surprised, reading this book, to discover that science and mathematics were considered more appropriate pursuits for girls (while philosophy and classical languages were better suited to boys) when Maria Mitchell was young. (How, in light of this history, do so many people get away with insinuating that females lack the intrinsic aptitude for science and math?) The stereotype in Mitchell?s youth that sciences were appropriate pursuits for girls seems to have been based on a certain kind of essentialism about what girls are like, as well as what I would identify as a misunderstanding about how the sciences operate and what kind of picture of the world they can be counted on to deliver. Mitchell, as much as anyone, seemed to be pushing her astronomical researches in a direction very different from the ?safe? science people expected ? yet in her writings, she also makes claims about women that could be read as essentialist, too. It?s hard to know whether these were these rhetorical moves, or whether Mitchell really bought into there being deep, fundamental differences between the sexes. This makes her story more complicated ? and more compelling ? than a straightforward narrative of a heroic scientist and professor battling injustice.

Indeed, there are moments here where I wanted to grab Maria Mitchell by the shoulders and shake her, as when she negotiated a lower salary for herself at Vassar than she was offered, even though she foresaw that it would lead to unfairly low salaries of the women faculty who followed her. Was her rejection of the higher salary just a matter of being honest to a fault about her limited teaching experience and her wavering self-confidence? Was she instead worried that accepting the higher salary might give the trustees an excuse not to take on the college?s first woman professor? Was opening the doors to other women in the professorate a more pressing duty than ensuring they would get the same respect ? or at least, the same pay ? as their male counterparts?

Given the seriousness with which Mitchell approached the task of increasing educational and professional opportunities for women, I can?t help but wondering how many of her choices were driven by a sense of duty. On balance, did Mitchell live the life she wanted to live, or the life she thought she ought to live to make things better? (Would she have drawn such a distinction herself?)

Some of these questions are connected to the various other strands of this rich biography. For example, Bergland does quite a lot to explore Maria Mitchell?s Quaker background, her own inclination to part company with the Society of Friends on certain matters of religious belief, the influence of her cultural Quakerism on and off Nantucket island, even how her plain Quaker dress made her an exotic and an object of curiosity during her travels through Europe at a time when the U.S. was arguably a developing country.

Bergland?s book is a captivating read that will be of interest to anyone curious about the development of educational institutions and professional communities, about the ways political and societal forces pull at the life of the mind, or about the ways people come to steer their interactions in many different circles to achieve what they think must be achieved.
